The Supreme Court of Brazil has agreed with Netflix to override the court order that asked it to remove from the platform of online video comedy The first temptation of Christ, producer of Porta dos Fundos. The company sent this Thursday a claim to the highest court in brazil against the decision of the judge Benedicto Abicair, the Court of Justice of Rio de Janeiro. The complaint was attended by the president of the Supreme, Antonio Dias Toffoli. Netflix argued that the measure imposed by “constitutional restrictions on freedom of expression, of creation and artistic development, infringing of this way of resolutions of the own Supreme that ensure the right to free artistic expression.

“we Support strongly the artistic expression and we are going to fight to defend this important principle, which is the heart of great stories,” said the spokesman for Netflix. Dias Toffoli ruled that “by virtue of the foregoing, and without prejudice to a new appreciation of the issue by the speaker, in giving the measure preliminary interim order to suspend the effects of decisions”.

In The first temptation of Christ, especially humorous that emits Netflix since December 3, the production company Porta dos Fundos shows the figure of jesus Christ and insinuated that he was homosexual. However, after the appeal in the second instance, the judge Benedicto Abicair, the sixth civil court of Rio de Janeiro, ended by granting the interim measure, which ordered that Netflix drops the production of its catalog until the court should meet and take a final decision, scheduled just after the break.

In its resolution, Abicair argued that “the right to freedom of expression, press and artistic is not absolute”. He also stated that “social networks are uncontrollable”, that all may enter in the online video platform, “including minors” and that “the title of artistic production does not reflect the reality of what is played”. And concluded as follows: “I Consider, therefore, most suitable and beneficial, not only for the christian community, but to the brazilian society, mostly christian, until you judge the merits of the resource, use caution to calm the situation, so I grant a preliminary measure interim in the form requested”.

The malaise that led to the comedy in sectors of conservatives and ultraconservatives in Brazil was such that, in the early morning of December 24, a group of men threw molotov cocktails at the headquarters of the producer, in Rio de Janeiro. No one was injured. That same week, several hooded released a video on YouTube taking responsibility for the attack and identifying with the integralism, catholic movement and orientation fascist emerged in the 1930s in Brazil. Days after, the Civil Police pointed out to the economist and businessman Eduardo Fauzi as the main suspect. Fauzi remains unaccounted for since the 31 of December, when the Police in Rio attempted to comply with the order of detention that the Justice issued against him. According to Police, the businessman fled to Russia on the 29th of December. On Wednesday, the Federal Police included the name of the economist in the list of the Interpol.
