The Constitutional Court has dealt another setback to the management of the pandemic by the Government and this Thursday has annulled the Government reform that left the judicial endorsement of the health restrictions of the autonomous communities in the hands of the superior courts of justice. TC sources have indicated that by seven votes (compared to four) the presentation of Judge Enrique Arnaldo in favor of declaring the unconstitutionality of this reform has been approved. Last year, the guarantee body already knocked down the two states of alarm decreed by the Executive. Four progressive magistrates have announced a particular vote.
The Plenary has thus considered the question of unconstitutionality presented by the TSJ of Aragon on the decision to leave the ball of the judicial guarantee in the hands of the autonomous communities.
After the controversy and diversity of criteria that this generated, the competence later fell directly to the Third Chamber of the Supreme Court.
