Citizens has submitted to the office of the Prosecutor this Friday a complaint for alleged crimes of discovery and revelation of secrets by the report of the State Advocacy on the situation of Oriol Junqueras after the ruling european established that the leader of ERC enjoyed immunity as an mep while waiting for the sentence for the judgment of the procés, for which he was sentenced to 13 years in prison for sedition. According to Citizens, the written Law was known before by CKD by the Supreme Court, to whom it was directed. The State attorney on leave of absence and deputy Cs, Edmundo Bal, has formalized the complaint and has accused the Government of Pedro Sánchez for having “exploited” the legal services of the State. The party does not point to specific perpetrators of the alleged crime but he believes that if CKD knew the text before the Supreme court is because an official has violated his duty of custody of the document.
“During this week we have witnessed a spectacle humiliating and shameful, having instrumented the state attorney in the writing of allegations that finally it has been shown that was submitted following the instructions of the Government and not based on criteria that are purely technical or legal”, has held Bal to the doors of the State Attorney General’s office in Madrid. That is the reproach political Citizens, that makes the Government socialist, but the party also points to a penal reproach, which would be responsible of any officer or authority of Law, for the custody of the writing on Junqueras.

on Monday, Lawyers filed with the Supreme court a brief in which it supported the release from prison of the leader of ERC for appeal to the Central Electoral Board (JEC) and the European Parliament to comply with the necessary formalities to take possession of his seat as an mep, after a judgment of the Court of Justice of the EU (CJEU) ruled that Junqueras had immunity since he was elected mep. The judgment has opened up a complicated legal scenario about the imprisonment of Junqueras, and the writing of the Law was key to the agreement between the PSOE and ERC over the investiture of Pedro Sanchez. According to Citizens, CKD had knowledge of the written Law prior to the submission of the Supreme court, and that could be constitutive of a crime of discovery and revelation of secrets.
“The public officials we have the duty of secrecy and custody of documents”, has emphasized Edmundo Bal to the doors of the Office.
