As the evaluation of video cameras in the parking garage revealed, two strangers entered the parking garage at night and had sex on the hood of the car. They left the parking garage after a few minutes without being identified. The damage to the car amounted to around 4600 euros.
The plaintiff argued that it was the car park operator’s job to continuously monitor the video recordings and to prevent “such activities” directly. However, the judges rejected his request for damages.
The court was unable to determine any breach of duty on the part of the operator, it said in justification. The cameras are installed in the car park more for “preventive purposes” – for example, to identify parking bumps after an accident using car license plates.
However, the court decided that “complete” monitoring and immediate intervention should not be required from the car park operator. The verdict is not yet legally binding.
