A 39-year-old had ignored the woman’s clear stop signal during role and bondage games – the Munich II Regional Court therefore sentenced him to a prison sentence of two and a half years for particularly serious rape and deprivation of liberty. The perpetrator and the victim had previously met several times to live out sexual fantasies. In “rape games” they implemented rape scenarios in role-playing games. However, during one of the meetings, the man ignored the woman’s boundaries, the court said.

As a safety precaution, the two had agreed on a so-called safe word: the man should stop immediately if the woman says “black heart”. At a meeting in Egling (Bad Tölz-Wolfratshausen district) in 2022, the 39-year-old initially adhered to this rule when the woman used the safe word – only to then tie her up again and take her with him despite the repeated stop signal to beat with a whip and to rape.

The defendant admitted the allegations in the trial and also paid compensation to the woman as part of a perpetrator-victim settlement. But because he had exploited a special relationship of trust, a suspended sentence was no longer justifiable given the specific circumstances of the crime, the presiding judge said in his judgment last Friday.

The verdict for particularly serious rape, grievous bodily harm and deprivation of liberty is not yet final. The defense and public prosecution have until October 20th to appeal to the Federal Court of Justice. The prosecution had demanded a prison sentence of three years and eight months, the defense a suspended sentence of a maximum of two years.
