Their alleged network was uncovered in a nationwide raid on Dec. 7. Based on the results of the investigation so far, the third criminal senate of the BGH considers it highly probable that they wanted to replace the free-democratic basic order with a form of government they had developed.
Apparently they had expected an “X-Day” attack on the state leadership by a secret society made up of foreign governments, armed forces and secret services. Her own organization was then supposed to fight the remaining institutions with force of arms, according to the accusation. Among other things, armed men should have entered the Bundestag and taken away MPs and members of the government.
The allegations were already known. The Federal Court of Justice has now announced that 20 suspects have strong suspicion that they are members of a terrorist organization and that they are preparing a highly treasonable company.
According to the relevant suspicion, the group was most likely a terrorist organization that aimed to violently change the constitutional order and thus commit constitutional high treason. The members would therefore have accepted that people would be killed in such a violent overthrow.
According to the investigation, not inconsiderable sums of money and equipment have already been collected. Some group members had guns and ammunition. There have also been target practice, so-called homeland security companies have been set up.
In the case of two of the accused, the BGH saw only the strong suspicion of supporting a terrorist organization. However, they too should remain in custody because of the risk of escaping, the other 20 also because of the suspicion of serious crime.
Since the procedure is extensive and difficult, it has not yet been possible to make a judgment, the BGH said. In May, three other suspected members of the group were arrested and held in custody.
