Justice B.R. Gavai is all set to become the 52nd Chief Justice of India on May 14, 2025, making history as the first Buddhist to hold the prestigious position. Dressed sharply in formals, Justice Gavai did not hold back when expressing his views on dealing with social media trolls who attack the court and its judges. He firmly stated, “If it’s about someone disrespecting the court, there’s no room for compromise.” The media got a taste of his no-nonsense attitude during an interaction held at his residence on Sunday.
As the son of former parliamentarian and Governor R.S. Gavai, Justice Gavai shared his family’s significant connection to Buddhism, with his father converting alongside Dr. B.R. Ambedkar back in 1956. With Buddha Purnima approaching, Justice Gavai reflected on his family’s faith and the milestone he’s about to achieve in his career.
When asked about the recent backlash faced by judges, especially in light of derogatory comments from BJP MP Nishikant Dubey, Justice Gavai acknowledged that different judges might have varying reactions to such situations. However, he made it clear that any attacks on the court’s integrity cannot be tolerated. He also addressed concerns about the Supreme Court’s use of power under Article 142, dismissing claims that it’s akin to launching a “missile.”
Justice Gavai emphasized the importance of High Court judges maintaining decorum both inside and outside the courtroom, suggesting that regular training could help improve judicial conduct. He reminded judges to exercise restraint, especially when discussing matters that are sub judice. Despite a few outliers, Justice Gavai reassured that the majority of High Court judges uphold the standards expected of them.
Regarding the disclosure of judges’ assets, Justice Gavai admitted that some judges have reservations about the information being misused. However, he personally follows the practice of revealing his assets to the Chief Justice, a habit he cultivated during his time in the Bombay High Court.
Expressing his views on the National Judicial Appointments Commission (NJAC), Justice Gavai believed that with some adjustments, it could be a positive step. He credited the Supreme Court Collegium for involving the government in recommendations. When it came to external pressures on judges, Justice Gavai stated that he hadn’t witnessed any undue influence during his career.
Looking ahead, Justice Gavai hinted at the Collegium’s decision to recommend more women judges to the Supreme Court Bench. With Justice Bela M. Trivedi’s impending retirement, he acknowledged the need for better gender representation in the judiciary. As for his own future, Justice Gavai asserted that he has no plans to take up any post-retirement positions once his tenure ends.
In times of national crisis, Justice Gavai believes that judges cannot remain detached, citing a Full Court meeting he convened following the Pahalgam terror attack. Paying tribute to the victims, he ensured a moment of silence across the Supreme Court, showcasing his commitment to the country’s well-being.
