“Is there a possibility that I can return to statutory health insurance as a working pensioner?”
Question: I am a pensioner since April this year and get 530,- € pension per month. I was self-employed until 2013 and had to give up operations due to illness (back surgery, titanium and cementation-back stiffening). Since I did not get a job due to my illness except on a 450,- € basis, I had to sell my house and was no longer financially able to pay the PKV and am therefore currently in the emergency tariff of the PKV. But since I have now found a company that would immediately hire me despite my retirement age at full salary, my question is: Is there a way that I can return to statutory health insurance as a working pensioner or what do I have to or can I do to get health insurance again?

First of all, even if it sounds harsh, the faulty provision must simply be addressed here. As a rule, this is not due to the person concerned, but to the consultants, who do not proceed holistically, but product-oriented.
Of course, the wishes of the customers are taken up first, the health insurance should have as low a contribution as possible, the scope of services is secondary and the long-term financial viability is not an issue in the consultation. Especially the self-employed, who are currently still insufficiently covered in the statutory social insurance, are hit hard here again and again.
A holistic planning should take into account both the contribution development over the next decades, as well as hard impacts such as illness or occupational disability. Unfortunately, this would lead to a higher consulting effort and ultimately to a higher contribution effort in the consultation, therefore these topics are often not taken into account. This is wrong and leads to acute problems if necessary.

Significantly better prospects before the 55th birthday
Unfortunately, the age of the person concerned cannot be recognized in the question. This is extremely important for assessing the situation. For persons who, for health reasons, draw a pension before their 55th birthday, the legislator provides for significantly easier return options to the statutory health insurance. After that, a return is not planned. Specialized legal service providers can sometimes still use gaps in the system, but there is definitely no longer a guarantee for this. Due to missing information, a final answer is not possible here.
The position of the legislator is understandable in a certain way here, because we grant self-employed persons a lead in the free organization of their own provision. Those who save the necessary contributions to their own provision for years or decades and put them in their own pockets must not be absorbed by subsidised social systems at the end of their working lives. The education and long-term care of the self-employed is far from sufficient in this area, therefore the described situation is unfortunately not an isolated case.

” I want to go back to the GKV, is that possible?”
question: “ladies and gentlemen, maybe you can help me… I have been privately insured since the mid-nineties. Self-employed since 2001. in 2016 I had to give up my independence due to illness (rheumatoid arthritis). Moved to Thailand with few reserves. Since then, unfortunately, no improvement has occurred due to illness. Had me duly deregistered in D. The expected pension would now be the end of 2001, about 1100,-€ gross. Basic tariff approx. 800, – € of the PKV… The remaining reserves will probably be used up by 2001. I would very much like to insure myself again in the GKV. Could you possibly help me with this? I will be 64 years old in October…”
In principle, the German Social Security System does not provide for this possibility of return. However, the individual individual case can be examined by a specialized legal service provider against fee and give you appropriate recommendations for action. A general statement without detailed examination is therefore not possible.
